Terms of Sale
1. Who we are
oriole.design is operated by SIA IdeaDesign, a company registered in the Register of Enterprises of the Republic of Latvia, registration No. 44103146603, VAT No. LV44103146603, legal address Piķurgas iela 48, Ulbroka, Stopiņu pagasts, Ropažu novads, LV-2130, Latvia. E-mail: [email protected] (“we”, “us”).
These terms apply to every purchase on oriole.design. The contract language is English. You can view, save and print these terms on this page at any time; the version valid when you placed your order is also linked in your order e-mail.
2. What we sell
- Digital ornament files for laser cutting and engraving, with a name already drawn into the design, in SVG, DXF and LightBurn (.lbrn2) format, delivered as a ZIP download.
- Bundles (fixed sets of files listed on the product page), the full library, and custom name files that we draw to order.
We do not sell physical products. Preview images on the website carry a watermark; the files you receive do not.
Technical requirements. To use the files you need software that opens SVG, DXF or LBRN2 files (for example LightBurn, Inkscape, Adobe Illustrator or CAD/CAM software) and a laser cutter or similar machine. Units are millimetres. Paths are closed and welded. Files are not kerf-compensated: you set your own offset for your machine and material. We recommend a test cut before production.
3. Licenses
Every file is sold with a Personal or a Commercial license, which you choose before buying. The full library is always sold with a Commercial license. The license terms form part of this contract. In short: the Personal license covers ornaments for yourself and as gifts; the Commercial license lets you sell the physical items you make. Selling, sharing or redistributing the digital files is never allowed.
4. Prices and VAT
- Prices are in euro (EUR). For consumers in every EU country the price shown is the final price including VAT; it does not change at checkout. We account for VAT in your country through the EU One-Stop-Shop scheme.
- Business customers established in another EU member state who enter a valid VAT number (checked in the European Commission’s VIES system) are invoiced without VAT under the reverse-charge mechanism.
- Volume discount on single name files in one order: 4 or more files 5%, 10 or more 10%, 20 or more 15%, 30 or more 20%. The discount does not apply to bundles, the full library or custom names.
- The price shown when you place your order applies to that order.
5. How the contract is concluded
- Choose a file, bundle or custom name and the license, and add it to the cart.
- At checkout, enter your details. You can check and correct everything you entered, and remove or change items in the cart, before placing the order.
- Tick the box confirming that you want the files supplied immediately (see section 8).
- Click Place order and pay. This is a binding order with an obligation to pay.
The contract is concluded when your payment is confirmed and we show the order confirmation page. We also send the confirmation, with the order details, these terms and the license, to your e-mail address. We keep a record of your order.
6. Payment
We accept card payments and other payment methods offered at checkout, processed by Stripe, and PayPal where shown. The amount is charged when you place the order. If Stripe offers you to pay in another currency and you choose it, Stripe converts the EUR price at the rate shown to you before payment. We never see or store your full card details.
7. Delivery
- Library files, bundles and the full library: download links appear on the order confirmation page immediately after payment and are sent to you by e-mail. Each file can be downloaded up to 10 times (each part of the full library up to 30 times). Links do not expire, but please save your files. If you need more downloads, contact us.
- Custom names: we draw the name in the design you selected and e-mail the files with a preview image, usually within 24 hours. Each ornament can carry up to 10 letters (we recommend 8 or fewer). If we cannot deliver within 7 days, or cannot draw the name in the selected design, we refund the full price. If anything in the delivered file is not right, including a spelling mistake made when ordering, tell us within 14 days and we send a corrected file once free of charge.
- If you do not receive our e-mail, check your spam folder or write to [email protected].
8. Right of withdrawal
As a consumer you normally have a 14-day right to withdraw from a distance contract without giving a reason. For digital content that is not supplied on a tangible medium, the right of withdrawal ends once supply has begun, if (a) you gave your prior express consent to supply starting during the withdrawal period, (b) you acknowledged that you thereby lose your right of withdrawal, and (c) we confirmed this to you on a durable medium (your order e-mail).
At checkout we ask for this consent and acknowledgement with a checkbox. Because files are made available immediately after payment, the right of withdrawal ends when we make them available to you. For custom names, you may withdraw until we have sent you the files.
Where your right of withdrawal applies, you can exercise it with our online withdrawal function, by e-mail or with the model form. Details, the model form and refund rules are on the Withdrawal & refunds page. Your statutory rights if a file is faulty (section 9) are not affected.
9. If something is wrong with a file
We supply files that match their description: the name spelled as shown in the preview, the design shown, the listed formats, and files that open in the software listed above. If a file is not in conformity with the contract, you are entitled to have it brought into conformity (we send a corrected file). If that is impossible, or we do not do it within a reasonable time, you are entitled to a proportionate price reduction or to terminate the contract and get your money back.
Consumers can make a claim within 2 years of supply (Latvian Consumer Rights Protection Law). Please tell us as soon as you notice the problem. Results that depend on your material, machine or settings (for example kerf, power, speed) are not defects of the file.
10. Complaints and dispute resolution
Send complaints to [email protected] with your order number and a description of the problem. We reply within 15 days.
If we cannot resolve a complaint, a consumer may apply to the Consumer Dispute Resolution Commission of the Consumer Rights Protection Centre of Latvia (Patērētāju tiesību aizsardzības centrs, Patērētāju strīdu risināšanas komisija), Brīvības iela 55, Rīga, LV-1010, Latvia, [email protected], www.ptac.gov.lv, or to an out-of-court dispute resolution body in their own country, or go to court.
11. Liability
Consumers: we are liable in accordance with the law, and nothing in these terms limits your statutory rights. Please make a test cut, because results also depend on your material, machine and settings. Business customers: we are not liable for material waste, machine damage or other indirect losses resulting from cutting or engraving the files, except where caused by our intent or gross negligence, and our total liability is limited to the price paid for the item concerned.
12. Intellectual property
All designs, drawings, files and preview images on oriole.design are protected by copyright and belong to SIA IdeaDesign. A purchase gives you a license to use the files as described in the license terms; it does not transfer ownership of the designs.
13. Business customers
If you buy in the course of a business, the right of withdrawal (section 8) does not apply, the liability limit in section 11 applies, and you are responsible for providing a correct VAT number.
14. Governing law and jurisdiction
These terms are governed by the law of the Republic of Latvia. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer law of your country, and you may bring a claim before the courts of Latvia or of the country where you live. For business customers, the courts of Latvia have jurisdiction.
15. Changes
We may update these terms. The version in force when you placed your order applies to that order.
